Management of Assets Upon Your Incapacitation
There are several estate planning tools that can be utilized to make decisions about your property when you are either temporarily or permanently unable to do so due to incapacitation:
§ Revocable Living Trust: This tool will allow a trustee of a living trust to make important financial decisions about assets in the trust when you are unable to. The trustee may be your spouse, a professional or a trusted friend;
§ Durable Power of Attorney for Property Management: This tool allows you to appoint an agent to make decisions about all of your assets (not just those in a trust) in the event you become incapacitated in the future. The agent's power can be broad or limited to certain types of property or decisions. The agent may be your spouse, a professional or a trusted friend.
